1. Products from Performance Media: Performance Media provides print and multi-media products as displayed in the brochure and on the web site, which include, training manuals and books, videos, and CD-ROMs.

2. Intellectual Property Right Protection: The products of Performance Media are copyrighted. Full rights and ownership are reserved for the products of Performance Media. Unauthorized duplication is a violation of all applicable copyright law.
No part of the works (products) including textual images and pictorial images, may be used, reproduced or transmitted in any form or by any means electronic or mechanical, including copying, recording, or by any information and retrieval system. Unauthorized lending, broadcasting, and public performance are prohibited. It is necessary to obtain expressed written permission for the use of any quotes for critical articles or reviews. 3. Payment Terms: Performance Media accepts cash, company checks, money orders, VISA, MasterCard, and American Express. Payment for products is made at the time of purchase. For companies requesting credit, an agreement can be established for payment on the basis of net 30 days. A finance charge of 1-1/2% per month, minimum of $5.00 per month, 18% per annum, will be assessed on all invoices 30 days past due.

4. Delivery Policy. Ordinarily for small orders, shipping is done by US Mail. For larger orders UPS is generally used. Acknowledged delivery dates are estimates of the time of delivery. Performance Media expressly disclaims liability for delays that may occur in delivery and any consequential damage from those delays.

5. Pricing Policy: Performance Media reserves the right to change prices, materials, and specifications for our products without notice or obligation.

6. No Other Agreements. This agreement and the accompanying Performance Media Limited Warranty and License Agreement (if applicable) constitute our entire agreement with you with respect to the shipped materials. Any inconsistent terms or conditions provided in your ordering documents are expressly rejected. Performance Media is not liable under, or bound by, any oral agreements, representations or other arrangements relating to your purchase.

7. Limited Warranty and Disclaimer. Performance Media warrants that the physical media containing the products shipped shall be free from material defects. WE HEREBY DISCLAIM ALL OTHER WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. CD-Rom and Software Licensing. If your order includes any Performance Media CD-Rom products or software, your purchase is subject to both the terms and conditions of this document and the Performance Media Limited Warranty and License Agreement set forth in the relevant document accompanying the CD-Rom or software product.

9. Guarantee Policy. If you are not satisfied with any product shipped, you may return it within 60 days for a purchase price refund. Shipping charges are not refundable. No product is replaced or credit given after more than sixty (60) days after the client receives the product.
